1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and BeautyBrain LLC ("BeautyBrain," "we," "us," or "our"), a California limited liability company, regarding your use of the BeautyBrain mobile application (the "App") and related services.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Age Requirement

You must be at least 17 years old to use the App. By using the App, you represent and warrant that you are at least 17 years old.

3. Description of Service

BeautyBrain provides AI-powered analysis of beauty product ingredients, safety assessments, and personalized recommendations. The App allows users to scan product labels, upload photos, and receive automated analysis of cosmetic and skincare products using a token-based system where each image scan requires one token.

4. Medical and Safety Disclaimers

IMPORTANT: The information provided by BeautyBrain is for informational and educational purposes only and is not intended as medical, dermatological, or health advice.

• AI analysis results are not guaranteed to be 100% accurate
• Product safety assessments are based on available data and algorithms, not clinical testing
• Individual reactions to products may vary significantly
• You should consult with a qualified healthcare professional or dermatologist before making decisions about skincare or cosmetic products
• BeautyBrain is not responsible for allergic reactions, skin irritation, or other adverse effects from products you choose to use
• Always perform patch tests and read product labels carefully

5. AI Analysis Limitations

Our AI technology provides analysis based on available ingredient databases and research, but:

• Results are estimates and may contain errors or omissions
• New research may change safety assessments of ingredients
• Individual skin sensitivities cannot be predicted by AI
• Analysis does not account for product formulation, concentration, or manufacturing quality
• Users should verify information independently and consult professional sources

6. User Accounts and Token Purchases

Account Creation

• Accounts are created using anonymous authentication
• You are responsible for maintaining account security
• One account per user

Token System

• Image scanning requires the purchase of tokens
• One token equals one image scan/analysis
• Tokens are consumed upon successful completion of an image scan
• Tokens do not expire but are non-transferable and non-refundable
• Token packages are available for purchase through in-app purchases
• Pricing for token packages may change with notice
• Refunds for token purchases are handled according to your app store's policies
• Unused tokens remain in your account until used
• We reserve the right to grant promotional tokens or bonuses at our discretion

7. User Content and Photo Uploads

Photo Uploads

• You may upload photos of product labels for AI analysis
• Photos should only contain product packaging and ingredients lists
• Do not upload photos containing personal information, faces, or inappropriate content

Content Guidelines

• Uploaded content must be legal and appropriate
• Do not upload copyrighted material without permission
• No nudity, harassment, illegal content, or spam
• We reserve the right to remove content that violates these guidelines

Content License

By uploading photos, you grant BeautyBrain a non-exclusive, royalty-free license to use, process, and analyze the content solely for providing our services and improving our AI algorithms.

8. Intellectual Property Rights

Our Rights

BeautyBrain and its content are protected by intellectual property laws. We own all rights to:

• The App and its functionality
• AI algorithms and analysis methods
• Ingredient databases and safety assessments
• App design, graphics, and user interface
• Analysis results and recommendations

Your Rights

You retain ownership of photos you upload, subject to the license granted above.

Restrictions

You may not:

• Copy, modify, or reverse engineer the App
• Extract or attempt to extract our ingredient database
• Use our AI algorithms outside the App
• Create derivative works based on our content
• Use the App for commercial purposes without permission

9. Prohibited Uses

You agree not to:

• Use the App for any illegal purposes
• Violate any applicable laws or regulations
• Interfere with App functionality or security
• Attempt to access restricted areas or data
• Upload malicious code or content
• Harass other users or BeautyBrain staff
• Use automated tools to access the App
• Misrepresent your identity or affiliation

10. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference.

11. Service Availability

• We strive to maintain App availability but cannot guarantee uninterrupted service
• We may suspend service for maintenance, updates, or technical issues
• We reserve the right to modify or discontinue features with notice

12. Disclaimers and Limitation of Liability

Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAUTYBRAIN SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Skin reactions or health issues from product use
• Errors in AI analysis or safety assessments
• Loss of data or service interruptions
• Damages exceeding the amount paid for tokens in the past 12 months

13. Indemnification

You agree to indemnify and hold BeautyBrain harmless from claims arising from:

• Your use of the App
• Your violation of these Terms
• Your uploaded content
• Your reliance on AI analysis results

14. Termination

By You

You may stop using the App at any time and delete your account through the App settings. Any unused tokens will be forfeited upon account deletion.

By Us

We may terminate your access for:

• Violation of these Terms
• Illegal or harmful activity
• Extended period of inactivity
• Technical or business reasons

Effect of Termination

Upon termination, your right to use the App ceases, but these Terms remain in effect regarding past use.

15. Governing Law and Disputes

Governing Law

These Terms are governed by California law, without regard to conflict of law principles.

Dispute Resolution

• Disputes should first be addressed through our customer support
• If unresolved, disputes will be resolved through binding arbitration under California law
• Arbitration will be conducted by a single arbitrator in California
• Class action lawsuits are waived

Exception

Either party may seek injunctive relief in court for intellectual property violations.

16. International Use

The App is available globally, but:

• Content is provided in English and based on international ingredient data
• Local regulations may differ from our assessments
• You are responsible for compliance with local laws
• Some features may not be available in all regions

17. Updates and Changes

App Updates

We may update the App to add features, fix bugs, or improve performance. Updates may be required to continue using the App.

Terms Changes

We may modify these Terms with 30 days notice. Continued use after changes constitutes acceptance of new Terms.

18. Miscellaneous

Entire Agreement

These Terms and our Privacy Policy constitute the complete agreement between you and BeautyBrain.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

Assignment

You may not assign these Terms. BeautyBrain may assign these Terms in connection with a business transfer.
